Cannabis Is Legal for Adults 21+ in New Jersey
New Jersey legalized adult-use cannabis in 2020 through a voter-approved constitutional amendment. Retail sales began in April 2022. Today, adults 21 and older can purchase cannabis from licensed dispensaries, possess it for personal use, and consume it on private property.

How Much Can You Buy and Possess?
Adults can purchase up to one ounce (28 grams) of cannabis flower per transaction, or equivalent amounts of other products. Home possession is capped at six ounces. These limits are generous enough for personal use but carry penalties if exceeded.
Product equivalencies matter. Five grams of concentrate equals one ounce of flower. One thousand milligrams of THC in edibles equals one ounce of flower. You can mix product types as long as the total stays within the limit.

Where Can You Consume Cannabis?
Private property:You can consume cannabis in your home, on your property, or at someone else's home with the property owner's permission. If you rent, check your lease: landlords can prohibit smoking and vaping in their units, though they generally cannot prohibit the use of edibles or other non-smoking methods.
Public places: Consuming cannabis in any public space is illegal. This includes parks, sidewalks, restaurants, bars, beaches, parking lots, and public transit. Some municipalities are beginning to authorize cannabis consumption lounges, but these remain rare.
Vehicles: You cannot consume cannabis in a vehicle, whether moving or parked, as a driver or passenger. This applies to all forms of consumption including smoking, vaping, and edibles.
Federal property: Cannabis remains illegal under federal law. Do not consume on any federal property, including post offices, federal buildings, military installations, or national parks within New Jersey.
Cannabis and Driving: Zero Tolerance
Driving under the influence of cannabis is illegal in New Jersey and carries the same penalties as alcohol DUI. There is no legal THC threshold in your blood; impairment is assessed by Drug Recognition Experts through behavioral evaluation and field sobriety tests.
Penalties for a first offense include up to 30 days in jail, license suspension for 7-12 months, and fines of $300-$500. Second and third offenses escalate significantly.
Our advice is absolute: never drive after consuming cannabis. Effects can last longer than you expect, and you may not perceive impairment even when your reaction time and judgment are affected. Use a rideshare, call a friend, or stay home.
Cannabis and the Workplace
New Jersey offers some employment protections for cannabis users, but they are limited. Employers generally cannot refuse to hire based solely on a positive cannabis test, but they can prohibit use during work hours, maintain drug-free workplace policies, and take action if you are impaired on the job.
Federal employers, contractors, and safety-sensitive positions (transportation, healthcare, law enforcement) may have stricter rules. If cannabis use and your job intersect in ways that concern you, consult an employment attorney familiar with NJ cannabis law.
The bottom line: consume on your own time, never at work, and never before driving to or from work.
Cannabis and Travel
Within New Jersey: You can transport cannabis in your vehicle in a sealed, original container stored in the trunk or a locked compartment not accessible to the driver. Do not open the package while driving.
Across state lines: Do not do this. Transporting cannabis across state borders is a federal offense, even between two legal states. New Jersey to New York, New Jersey to Pennsylvania, New Jersey to anywhere: all illegal under federal law.
Air travel: Airports are federal jurisdiction. TSA is a federal agency. Do not bring cannabis to any airport, even within New Jersey. Flying with cannabis is a federal offense.
Public transit: Consuming cannabis on NJ Transit buses, trains, or at transit stations is illegal. Possessing sealed cannabis products while riding transit is legal.
Safe Consumption Tips
Start Low, Go Slow
Especially with edibles. Begin with 2.5-5mg THC and wait at least two hours before taking more. Edible effects take longer to onset and last longer than smoking.
Know Your Strain
Indica-dominant strains tend toward relaxation and body effects. Sativa-dominant strains tend toward energy and mental stimulation. Hybrids offer a blend. Ask your budtender for guidance.
Stay Hydrated
Cannabis can cause dry mouth and mild dehydration. Keep water nearby. Avoid excessive alcohol consumption when using cannabis, as the combination amplifies impairment.
Create a Safe Environment
Consume in a comfortable, familiar setting, especially if you are new. Have snacks, water, and entertainment available. If you feel anxious, remember: it will pass.
Never Drive Impaired
Plan your transportation before consuming. Use a rideshare, walk, or stay where you are. Cannabis impairment can last several hours, especially with edibles.
Respect Tolerance Differences
Everyone responds differently to cannabis based on body weight, metabolism, tolerance, and the specific product. What works for your friend may be too much or too little for you.
Storing Cannabis Safely
Proper storage protects both the quality of your cannabis and the safety of people in your household:
- Keep it locked. If children or minors live in or visit your home, store cannabis in a locked container or cabinet. This is a responsibility, not an option.
- Keep it cool and dark. Light, heat, and humidity degrade cannabis quality over time. A cool, dark cabinet or a sealed jar in a drawer is ideal.
- Keep it sealed. Airtight containers prevent odor, preserve freshness, and keep moisture out. Glass jars with tight seals work well.
- Label clearly. If you have multiple products, especially edibles, label them clearly. Edibles can be mistaken for regular food.
- Away from pets. Cannabis, especially edibles, can be harmful to dogs and cats. Store all products where pets cannot reach them.
