How Much Can You Buy at a Dispensary?

New Jersey law limits adult-use cannabis purchases to one ounce (28 grams) of dried cannabis flower per transaction, or equivalent amounts of other product types. This is a per-transaction limit, not a daily limit. In practice, most dispensaries track purchases per visit.

The one-ounce limit is based on flower weight. Other products are measured against this baseline using an equivalency chart established by the Cannabis Regulatory Commission. You can mix different product types in a single transaction, as long as the total does not exceed one ounce equivalent.

Medical patients may have higher purchase limits based on their physician's recommendation and their allotment within the New Jersey Medicinal Marijuana Program.

Mixed Purchase Example

You want to buy a half ounce of flower (14g) and some concentrates. Since 14g of flower equals half your transaction limit, you can add up to 2.5g of concentrates (half the concentrate equivalent). Together, these equal one full ounce equivalent.

Home Possession Limits

Home possession limits are more generous than purchase limits. New Jersey law allows adults 21 and older to possess up to six ounces (170 grams) of cannabis at their residence. This accommodates the reality that people may purchase cannabis over multiple visits and store it at home.

Possession of more than six ounces but not in a quantity suggesting distribution is classified as a disorderly persons offense. Penalties for exceeding the limit include up to six months in jail and/or fines up to $1,000. Possessing amounts that suggest intent to distribute carries significantly higher penalties.

Store your cannabis securely, in a locked container or cabinet, away from children and pets. This is not a legal requirement for adults, but it is a responsible practice and may be relevant if children are present in the household.

In Your Vehicle

Transport Rules

You can transport cannabis in your vehicle, but there are specific rules:

  • Cannabis must be in a sealed, closed container. The original dispensary packaging qualifies.
  • Store it in the trunk or a locked compartment not accessible to the driver or passengers.
  • Do not consume cannabis in a vehicle, whether moving or parked, as a driver or passenger.
  • Do not transport cannabis across state lines, even to another legal state. This is a federal offense.

If you are pulled over and an officer sees cannabis in your car, having it in its original sealed packaging in the trunk demonstrates compliance with the law. Open containers or cannabis accessible to the driver may raise impairment concerns.

Consequences

Penalties for Exceeding Limits

  • Up to 6 ounces (personal): Legal. No penalty for adults 21+.
  • Over 6 ounces (no distribution intent): Disorderly persons offense. Up to 6 months jail, up to $1,000 fine.
  • Over 1 ounce with distribution intent: Fourth-degree crime. Up to 18 months imprisonment.
  • 5 pounds or more: Second-degree crime. Significantly increased penalties including years of imprisonment.
  • Sale to a minor: Enhanced penalties regardless of quantity.

The threshold between personal possession and distribution is not always black and white. Factors like packaging materials, scales, large amounts of cash, and quantity all factor into prosecutorial decisions. The simplest way to stay on the right side of the law: buy from licensed dispensaries, stay within possession limits, and never sell or distribute.

Gifting & Sharing

Can You Share or Gift Cannabis?

New Jersey law permits adults 21 and older to gift cannabis to other adults 21 and older, as long as no payment or exchange of value is involved. You can share a pre-roll with a friend at their house. You can bring an edible to a dinner party. You can gift cannabis as a present.

What you cannot do is use gifting as a cover for sales. The so-called “gifting loophole” that some sellers exploit (selling a t-shirt or painting and “gifting” cannabis with the purchase) is illegal. The CRC and law enforcement have explicitly addressed this practice, and enforcement actions have been taken against unlicensed operators using gifting schemes.

The rule is straightforward: if money or anything of value changes hands in connection with a cannabis transfer, it is a sale, and sales require a CRC license.
